Notice of Regulatory Workshop & Agenda State Environmental Commission Rules of Practice February 7, 2012 The State Environmental Commission (Commission) is proposing to modify its Rules of Practice as codified under Nevada Administrative Code (NAC) 445B.875 through 445B.899. Background: The regulations found in NAC 445B.875 through 445.895 govern practice before the Commission in contested cases under NRS 233B.121. The purpose of the workshop is to solicit comments from interested persons on the following general topics that may be addressed in the proposed regulation, R135-11: (1) appeal to be based on the standard of review grounds set forth in NRS 233B.135(3); (2) briefing requirements; (3) witness and exhibit identification; (4) prehearing conferences; (5) evidence limitations; (6) dismissal of appeals ; and (7) state bar status of attorneys in contested cases. Workshop Date, Time & Locations: The workshop to solicit comments on proposed regulation will be conducted as a video conference in Carson City and Las Vegas. The workshop location in Carson City is the Bryan Building, 901 South Stewart Street (4nd floor south, conference room).
